Terms of Service

1. Acceptance of Terms

By accessing or using Pravab ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

Pravab is a marketplace platform that connects influencers with brands for collaboration opportunities. We facilitate the discovery, negotiation, and management of influencer-brand partnerships.

3. Account Registration

• You must be at least 16 years old to create an account
• You must provide accurate and complete information during registration
• You are responsible for maintaining the security of your account credentials
• You may register using email/password or through third-party authentication providers (Google, Facebook)
• One person or entity may not maintain more than one account of the same type

4. User Types

4.1 Influencers

Influencers create profiles showcasing their social media presence and audience. By using the Platform, influencers agree to provide truthful information about their audience metrics and engagement rates.

4.2 Brands

Brands create profiles and post collaboration opportunities. Brands are responsible for clearly communicating campaign requirements, deliverables, compensation, and timelines.

5. Collaborations and Payments

• Collaborations are agreements between influencers and brands facilitated through the Platform
• Payment terms are agreed upon between the parties during the collaboration setup
• Pravab may charge a service fee for facilitating transactions
• All payments processed through the Platform are subject to our payment terms
• Disputes between influencers and brands should first be resolved through our Platform's dispute resolution process

6. Content and Intellectual Property

• You retain ownership of content you upload to the Platform
• By uploading content, you grant Pravab a non-exclusive license to display it on the Platform
• You must not upload content that infringes on others' intellectual property rights
• Content created as part of a collaboration is subject to the terms agreed between the influencer and brand

7. Prohibited Conduct

You agree not to:

• Provide false or misleading information
• Use fake engagement metrics or inflated audience numbers
• Harass, abuse, or harm other users
• Use the Platform for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the Platform
• Scrape or collect data from the Platform without permission
• Circumvent the Platform to avoid service fees

8. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through your account settings or by contacting us. Upon termination, your right to use the Platform ceases immediately.

9. Disclaimers

• The Platform is provided "as is" without warranties of any kind
• We do not guarantee the accuracy of user-provided information
• We are not responsible for the outcome of collaborations between users
• We do not endorse any influencer, brand, or collaboration

10. Limitation of Liability

To the maximum extent permitted by law, Pravab shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Platform. Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.

11. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes via email or through the Platform. Continued use after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Nepal. Any disputes shall be subject to the exclusive jurisdiction of the courts in Nepal.
